二十世纪中后期中国主流法律观的文本考察

The Main Chinese View of Law in Middle and Late 20th Century The Textural Review of Tung Pi-Wu and P'eng Chen

中国整个二十世纪中后期的法律思潮都被执政党的法律观所主导,而意欲透析后者则有必要对董必武和彭真这二位党内法学权威的思想进行研究和比较。本文将"法律是什么"这一法律观的根本性问题分解为"法律与时代任务"和"法律与执政党的关系"二个子命题,通过论述和分析董、彭有关法律的论著,得出结论认为,此一阶段主流法律观是服务目的理性论和政党目的理性论的结合,在本质上是一种目的理性主义。文章的最后一部分简要分析了法律目的理性主义的影响、理论困境及能否消解等问题。

The legal trend of thought in the whole period of middle and late twenty century was dominated by view of law proposed by the governing party. It is necessary to study and compare the thoughts of Tung Pi--Wu and P＇eng Chen ,who were legal authorities inner the Party. This article firstly divides the basic problem invie of law ＂what is law？＂, to two sub-- propositions -- ＂law and mission of era＂ and ＂the relation of law and the governing party＂ ;then analyzes and characterizes them by a conclusion that legal view of the governing party comprises of theory of service--instrument and that of party--instrument,and it＇s an aim--rationality in nature. The last section of this article analyzes briefly the influ ence and theoretical paradox of legal aim--rationality, the possibility of it＇s discard and so on.
