存疑不起诉是我国不起诉制度中的一个重要组成部分,体现了疑罪从无的司法理念。在司法实践中存疑不起诉被滥用、误用的情况比较普遍,原因既有立法规定不健全、不完善等问题,也有办案人徇私、徇情的问题,而对证据审查判断的偏差,把握的不一致、不统一是导致存疑不起诉适用不规范的重要原因。存疑不起诉的正确适用对于保障人权、实现诉讼公正与效率的双重价值具有重要意义。为了更好地维护公平正义,正确履行检察职责,准确行使存疑不起诉权,本文对甘肃省检察机关2003年至2007年存疑不诉案件的数据进行了统计和分析,对典型个案进行了专项调查和研究,分析出全省检察机关五年来存疑不诉案件的特点,进而从立法、侦查、检察等环节总结了办理存疑不诉案件中存在的问题,多层面、多角度的进行了原因分析,针对存在的问题和原因提出了相应的解决对策,以期对提高办案质量、正确适用存疑不起诉有所裨益。

In order to better safeguard the fair and justice, and correctly perform the procuratorial responsibility, and accurately exercise the power of nol pros, this article carries on statistics and analysis to the case data of non--prosecution with doubts of procuratorial organization of Gansu Province from 2003 to 2007, investigation and research to the typical cases, analyses the characteristic of the cases of non--prosecution with doubts in five years, sums up the questions of the cases of non--prosecution with doubts from legislation, investigation to prosecution in the application, analyses the reasons from the many layers, and puts forward the corresponding settlement countermeasure in accordance with these reasons, and in the hope of having some benefit to the judicial practice.
