摘要
美国高等教育立法内容丰富,层次完善,其发展历程的文化积淀和法律精神使其显现出明显特征,成文法占据主体地位,教育法律体系完备,其执行、监督制度也日益完善成熟。法律制度背后所体现的原则精神则表现为平等、自治、民主、权利救济,以保障美国教育法律的执行和监督。
The American higher educational legislation is abundant in content, the level is complete, its culture accumulation and legal spirit of development course make it display obvious characteristic, the written law occupies the subject position, the educational legal system is complete, and the execution and supervisory system is improved day by day. The principle spirit behind the legal system reflected the equality, autonomy, democracy, right relieved, in order to ensure the execution and supervision of American educational law.
