On the Procedural Function of Community Correction

服务于个别化矫正罪犯、保护受害人、修复被犯罪破坏的社会关系等多重目的,作为一种实体性法律程序,社区矫正程序有限制恣意,引导和规范主体行为,弥补和发展实体法,保证民主参与的作用,在社区矫正过程中承载着权力制约、提供效率、制度生成和民主参与等多项功能。

For individually correcting the crimes, protecting the victims, rehabilitating the social relations, as a substantial procedure, the community correction procedure plays an important role in restricting the arbitrariness, inducing and defining the subjective action, offsetting and developing the shortage in the criminal law, ensuring the effectual participation, and having the functions of restricting power, giving efficiency, making systems, and participating procedure.
