摘要
在现行版权保护体制下,图书馆在购买数字资源时与数据出版商以合同形式规范双方权力与义务成为基本合作模式。但是,就版权保护制度建设宗旨与数字出版业可持续发展而言,这种格局还存在种种弊端,从而引发图书馆界新一轮更深层次的思考。为此,需进一步探讨在图书馆与出版业的博弈与制衡过程中,如何逐步接近与实现所预期的和谐,并且平衡著作权保护格局的基本思路。
This paper mainly discusses the basic cooperation pattern for library to standard both sides＇ rights and obligations by the form of contract when purchasing digital resources from data publishers under the present copyright protection system. However, in terms of the objective of copyright protection system construction and the sustainable development of digital publication industry, this kind of pattern still has some disadvantages, which has initiated deeper thinking in the circle of library .Then the paper discusses how to approach and achieve harmony anticipated gradually in the process of bilateral game and balance, and the basic measures to balance the copyright protection.
