摘要
TRIPS协议以内容全面、效力广泛的特点自出台起就成为理论界研究的热点。通过评述其中商标权保护规则,指出商标法律发展的趋势,分析我国现行商标法对其的吸收和借鉴,探求与TRIPS相衔接的并与我国国情适应的立法完善策略。
The TRIPS agreement has become a hot spot of research in the theoretical circles since its introduction, due to its comprehensive content and wide-ranging effectiveness. This paper, by reviewing the rules for the protection of trademark rights, points out the development trend of the trade mark law, analyses the absorption and using for reference of China＇s current trademark law from this agreement, and explore China＇s strategy of legislative perfection both in line with the TRIPS agreement and China＇s national conditions.
