试论招投标市场的依法监管

On the Supervision in Accordance with the Law of the Inviting and Entering Bids Market

《中华人民共和国招标投标法》的颁布与实施,标志着我国招投标市场已经步入法制化轨道,其投融资体制改革和公共采购也进入了一个全新的发展时期。与此同时,由于监管体制不配套,政出多门、暗箱操作、地方保护主义等问题也日益凸显出来。因此,要完善招投标市场的监管体制,必须做到法制化、制度化;必须及时、准确把握我国招投标市场的现状和走向;必须严格规范、引导招投标市场的有序竞争;必须不断强化对招投标市场的依法监管和处罚力度。

The promulgation and carrying out of the law of the inviting and entering bids of the People＇s Republic of China marked that our country＇s inviting and entering bids market had come into the legal course. In the meanwhile, our country＇s reform of capital investment and circulating funds and public purchase has also coming into a complete new developing period. But, owing to the unformed complete set of the supervision, government decree coming from different department, operating in secret, local protectionism and so on, have appeared increasingly. If we want to perfect the system of supervision of the inviting and entering bids market, we must set up legal systems and systematic procedures, must grasp the present conditions and developing directions accurately and promptly, must standardize and guide inviting and entering bids market strictly and compete in order, and must strengthen and quantize the supervision of the inviting and entering bids market and extent of punishment unceasingly.
