从一起地铁人身伤亡事故谈城轨交通损害赔偿责任与免责

Discussion on Liability and Exemption of Compensation for Damage in Transit from a Metro Personal Injury Accident

鉴于国内一些城市关于轨道交通损害赔偿责任处理原则和免贵条件的地方性法规不符合我国《民法通则》和《立法法》法律规定,有必要结合城市轨道交通危险作业特征,按照无过错赔偿责任原则和《民法通则》规定的免责条件,尽快出台一个符合国家《民法通则》且统一的城市轨道交通人身损害赔偿责任规则。

For operation departments of transit in China,there are great dif- ferences between the treatment of compensation liability and the un- derstanding of exemption conditions for personal injury accidents. Moreover,the relevant contents of some local regulations are not in accordance with the rules of General Civil Law and Legislation Law of China.Combining with the dangerous operation characteristics of transit,it is necessary to define transit as high-speed transport tool. According to the principles of no-fault compensation liability and the exemption conditions stipulated in General Civil Law,as well as the determination of liability of compensation for damage,the legal, suitable and unified regulations of liability of compensation for per- sonal damage should be issued.
