国企改革的民商法调整若干问题研究

On Adjustment of Civil and Commercial Law in the Reform of State-owned Enterprises

我国国有企业改革的法律调整是一个由行政法、民商法和经济法等法律部门组成的综合调整机制,文章主要从民商法的角度对其调整的必要性、形成过程、主要成绩、调整方式以及局限性进行了分析,指出现阶段国企改革必须建立和完善以民商法、经济法为主导的法律调整机制。

Our country＇s law adjustment in the reform of the state-owned enterprises is a comprehensive adjustment system composed of administrative law, civil and commercial law and economic law. The paper, from the angle of civil and commercial law, tries to analyze the necessity, the forming process, the main contribution, the adjustment way and the limitation of the adjustment of the civil and commercial law in the reform of the state-owned enterprises and the paper also pointed out that the reform of the state-owned enterprises should build and perfect law adjustment mechanism lead by civil and commercial law and economic law.
