Between Cooperation and Confrontation——A Preliminary Research on the Practical Pattern of Impact Litigation

通过对近年中国新出现的一种法律诉讼形式——"影响性诉讼"影响公共秩序的实践方式的探究,考察了民间意在诱导宏观制度变迁的努力应当以何种形式才能切实达到与国家的良性互动,进而对公共秩序的建设有所推进的问题。借助合作主义视角,分析"影响性诉讼"现有实践方式的内在张力与缺失,并探讨了可能的改革之道。

This paper focuses on a new pattern of Chinese litigation--impact litigation, especially its influence on public order. With the researches of Corporatism, this paper gives a reasonable scheme of how the civil society can build a bridge in order to communicate the state and the society, and how the changes of institution can be more feasible.
