论我国人体器官移植过程中的“公平与公正原则”

On the Principle of Justice and Fairness in Human Organ Transplantation in China

公正具有"等利(害)交换"的属性,公正原则的根本问题是基本权利完全平等和非基本权利比例平等;公正在医疗卫生领域中的运用,即为医疗公正。在人体器官移植过程中,要坚持对器官移植接受者和捐献者的公平与公正原则,要建立实现公平与公正的有效社会保证机制。

Justice means equality in exchanging benefit （harm）. The essence of the principle of justice is absolute equality of basic rights and proportional equality of no-basic rights. Medical justice refers to the application of the principle of justice to the medical realm. The principle of justice and fairness should be observed in human organ transplantation, both for donors and for patients. Efficient social guarantee mechanism should be constituted to achieve this goal.
