摘要
作为两个有着密切关系的学科,国际关系与国际法在二者发展过程中却渐行渐远,这是由国际关系现实主义理论兴起并占据主导地位的历史原因造成的。现实主义的"利益"、"权力"观与国际法的"权威"、"服从"理念无法调和,导致国际法受到冷落和排斥。但近年现实主义的全新发展形式"共生现实主义"的出现,开启了现实主义包容国际法的大门,其所主张的"双重本体论"、"多元化的行为体及治理结构"以及以共生关系为基础的"国家偏好"取向,是对国际法的全面接纳,体现了现实主义国际法观的重大转变,为国际关系理论与国际法的全面互动带来了新的曙光。
Despite the close interrelationship in between,the two disciplines of International Relations and International law are going to have more differences.This is mainly because of the rise and leading role of realism theory in International Relations.Realism's understandings to 'Profit' and 'Power' diverge greatly from views of 'Authority' and 'Obedience' in International Law,thus resulting in the spurn and repulsion of International Law.However,Realism has recently developed a new view of 'Symbiotic Realism',which makes International Law comparably been accepted.This new view protests ideas of 'Dual Ontology','Multi-actors and Governance Structure' and a symbiotic-relation-based 'Nation Preference'.All these ideas reveal that International Law is fully accepted and there is a shift in realism view upon International Law.This signs a good beginning of an all-round interaction between International Relations theory and International Law.
