试论城市房屋拆迁问题的解决

Solutions to the Issue of Urban Housing Demolition

城市房屋拆迁已成为当今社会一个敏感而又普遍的社会问题,关系到千家万户的切身利益,广为社会所瞩目,而政府行政权力的强制介入拆迁是激化拆迁矛盾酿成双方冲突的主要原因和导火索。本文尝试在理论上用公共利益这一评判标准将拆迁领域一分为二,在因公共利益而为的拆迁领域容许政府行政权力介入规范;非为公共利益则排除政府强制介入的权力。这一双轨制的解决方案或对这一社会问题的解决有所帮助。

Urban housing demolition, a sensitive and widespread social problem, is related to the vital interests of millions of households, therefore attracting the attention of the public. Unfortunately, the compulsory intervention of the executive powers in the process intensifies the contradictions between the two parties. This paper attempts to divide the demolition into two areas, allowing government intervention for the demolition concerning public interest while ruling out such interventions for non - public interest projects.
