摘要
行政机关间的权限冲突,在行政活动中广泛存在。传统的行政途径和方法,已难以解决各部门各自为政、相互重叠交叉或相互推诿的现象,大部制改革也无法从根本上消除冲突。落实行政组织法首长负责制的原则,充分发挥各级人民政府在解决所属各部门之间的权限冲突中的中枢神经系统作用,通过法制化途径由政府法制工作机构对权限争议进行裁决,是从制度上解决行政权限冲突的常效机制。
The extent of authority conflicts broad existed in the administration activity. Traditional approach and method of administration has difficult to resolve phenomenon of every organ working each for iosself, alternating and shuffling mutually. Greater Department system also had no way to comply with resolring conflict fundamentally. Practicing the principle of the leading cadre is in charge of system in Administration constituent act, bringing all of the various levels of the People Governments into play central nervous system effect to resolve extent of authority conflicts between every organ, it is imitate mechanism to carry out adjudication on extent of authority from government legal institutions operating mechanism by institutionalize approach.
