随着5.12汶川特大地震抗震救灾从生命救助转向灾后重建,由地震导致的房地产毁损灭失而产生的一系列法律问题逐渐摆在了我们的面前:房屋在地震中损毁,由谁来“埋单”?居民个人所有的房屋毁损灭失,但其土地使用权仍然受到法律保护。居民又如何行使那可能只有几个平方米的土地使用权?
