论死亡赔偿金的性质——兼评法释[2003]第20号相关规定

On the Nature of Compensation for Death——with a Comment on the Relevant Provisions in Judicial Interpretation20

死亡赔偿金性质的厘清对正确理解我国当前死亡赔偿中的争议具有本原性的作用,论题对现行死亡赔偿金所采用的继承丧失说之法理局限和实务困境进行检视的基础上,力图发现其中的问题,并提出解说,从而结合我国当前实际对其予以合理的界定,即死亡赔偿金是对死亡本身的赔偿,其性质是加害人侵害他人生命权而支付的惩罚性的定额赔偿金。

In our country, clarifying the nature of compensation for death plays a primitive role in the correct interpretation of the present controvemial argument in the practice of death compensating. This paper, based on the research on the legal limitations of existing lose of inheritance and difficulties in practice of death compensating, tries to find out the problems and give them reasonable explanations so as to define compensation for death soundly according to the current legal practice in our country. Compensation for death is a punitive rated compensation paid to the beneficiary by the offender for his violation against other＇ s right to life.
