Dworkin's Theory of Equality and Right

平等是德沃金权利理论的起点和核心。其理念中的平等包含二层意思.即把所有人作为平等的人来对待和平等对待的所有人。该权利理论在阐释平等内涵的基础上揭示了平等是现代权利观念的前提.在缺乏平等观念的社会,个人权利观念必然难能发达;并指出平等是各种权利生长的沃土,个人享有的许多权利如反对压制和反对歧视等恰恰都是从平等理念中衍生出来的。

Dworkin＇s theory of right regards equality as the starting point and the core. Equality means the government regards all the people as the same, and deals everything of the people with the same attitude .The theory reveals that equality is the premise of the modem concept of rights through expounding the connotation of the equality. During the society for lack of equality ideas, concept of rights mustn＇t develop.In his theory, equality is the fertile soil. Many individual rights derive from the idea of equality such as opposing the autocracy and the discrimination.
