论反垄断法对中小企业的保护——兼论我国《反垄断法》相关条款的完善

On the Protection of Medium-and-Small-sized Enterprises:A Discussion of Improving Related Terms in Anti-Monopoly Law

保护竞争、不保护竞争者是反垄断法的一项基本原则。反垄断法并不直接保护中小企业,而是通过对不法垄断行为的制裁、适用除外和豁免等方式,客观上为中小企业创造一个参与公平竞争的市场环境,从而间接地起到保护中小企业的作用。我国反垄断法应借鉴国外的经验,对保护中小企业参加市场竞争发挥作用。

Protecting competition other than competitors is a basic principle in Anti-Monopoly Law. Anti-Monopoly Law does not protect medium- and small-sized enterprises directly, but indirectly through creating a market environment for them to participate in market competition fairly. Anti-Monopoly Law in China plays an important role in the protection of medium- and small-sized enterprises by drawing on foreign experience.
