摘要 《劳动合同法》第14条是该法颁布实施前后引起社会争议最大的条款,该条规规定了无固定期限劳动合同,并在适用条件和适用范围等方面比《劳动法》的相关规定更宽泛,在一定程度上增大了企业的用人成本,导致众多企业对该条法律规定有所抵触。文章通过阐述无固定期限劳动合同的立法意义,比较《劳动合同法》与《劳动法》对无固定期限劳动合同规定的不同之处,并解析无固定期限劳动合同的适用,以期修正企业对无固定期限劳动合同有失偏颇的理解。 Article 14 of "Labor Contract Law" caused the most social controversy during the promulgation and implementation of the law, because in this article, the "Labor Contract Law" stipulated the non-fixed term labor contract system, and the condition and scope of the application is much more wider than the regulations stipulated in "Labor Law". The reguahion of Article 14 seems somehow increased the labor cost for enterprises, and thus caused many conflicts from a lot of enterprises. This thesis provides a description for the legislative significance of "Labor Contract Law", makes a contrast of the regulations on non-fixed term labor contract system between "Labor Contract Law" and "Labor Law", gives an analysis on the implemta- tion for the non-fixed term labor contract,in order to correct the misunderstanding of the enterpirses towards the non-fixed term labor contract.
