中国"无讼"法律文化的历史根源于古人"天人合一"的自然和谐观,其存在的基础是一家一户的小农经济以及与此相连的宗法家族制度。无讼既是中国古代社会统治者的政治追求,也是普通百姓的生活准则,在这种思想的指引下,古人创造了貌似和谐的古代文明。但是,"无讼"法律文化却与当代中国法制建设的理念相悖,并严重影响了当代社会法制建设的进程。

The mind is run after by the statesman in Chinese ancient, at the same time ,it is also a life criterion of the common people. Under this idea, the ancients have created seemingly harmonious civilization. But, the law culture has gone against the idea of Chinese legal system building at present and affected its course gravely.
