宏观调控与私人选择--房地产市场价格调控措施的个别检验

Macro Control and Private Choice:Individual Inspection on Macro-control Measures Concerning the Price of Real Estate

近年来,房地产价格调控虽措施频出,却收效甚微。对若干调控政策的个别研究表明,房地产市场的宏观调控已步入误区。私人自治是市场社会的根基,宏观调控应当维持私人自治与公共管制之间的平衡,只有建立在私人自治基础上的调控政策才具有正当性。因此,宏观调控措施应当具有向后效应,调控不应增加已确定的私人交易的费用;宏观调控措施还应具有间接效应,调控只应引导而不是直接替代私人的交易决策。宏观调控应在私人自治而非行政命令的基础上展开。

Although many macro-control measures have been taken in recent years, their effect are very limited.The paper studies on certain macro-control policies and points out that the macro control of real estate market had gone to a wrong direction.As private governance is the foundation of the market society,macro-control policy should balance individual autonomy and public regulation.Only those macro-control measures based on private governance are justified.Therefore,macro-control measures should have the back effect as well as indirect effect,which means the regulating policy shouldn't be used for increasing the due cost of private transactions or making a decision for private transactions,instead of giving an instruction.Macro-control measures shall be carried out in accordance with the principal of private governance,not with administrative orders.
