商法公法化是私法公法化的具体表现形式,它在立法上的主要表现有:商法价值理念的转变;商事立法中强行性规范增多;商行为后果承担上的严格责任主义等。这一法律现象的产生有其深刻的社会原因,然而这种公法化的趋向,并不意味着商法已经属于公法,商法固有的私法属性不变。
