公共建设项目工程设计责任险问题研究

Research on Liability Insurance for Design in Public Construction Projects

在许多公共建设项目中,设计单位违反合同约定导致业主遭受损失时,设计单位的赔偿责任是很有限的,这使得业主承担着巨大的工程风险。本文针对这一问题,分析了其中原因,建议在设计合同中加入要求设计单位投保工程设计责任险的条款,并提出相应的操作办法。

In most of public works, regulations on compensation responsibility in design contract are so limited when breach of contract by design enterprises leads to the loss of owners, which makes the owners assume tremendous risks. This paper analyses the reason of the phenomena, and proposes to add the clause of liability insurance for design enterprises, and some concrete implementary suggestions are also given.
