摘要
农村宅基地是否可以自由流转,关乎农民的切身利益。我国相关法律禁止农村宅基地流转。从产权的构成、功能和不可转让性规则角度分析,限制宅基地流转破坏了产权的完整性,并且有悖于不可转让性规则的理论基础,宅基地使用权应当自由流转。
According to the provisions of law, rural residence land usufruct is forbidden to transfer in China. This article analyzes the issue from the perspective of law and economics, and apply theory of property rights, theory of transaction costs and inalienability rules to justify the transfer of rural residence land usufruct.
