善意取得制度适用对象探析——从历史与比较考察的视角

On suitable objects of bona fide possession——From the view of history and by comparison

善意取得是物权法上维护交易秩序、保障交易安全的一项重要制度。从善意取得制度的缘起与变迁来看,善意取得制度起先只适用于动产物权,但其后发展适用于不动产物权;现代各国善意取得制度适用有两种规范模式,建立在不同物权变动模式上的不同立法选择均有其合理性;而我国《物权法》规定不动产物权的善意取得是符合我国立法实际的正确选择。

Bona fide possession is a very important legal system for safeguarding transaction order and security in the ＇Reality of laws＇. By exploring origin and vicissitude of bona fide possession, we point out that the system of bona tides possession only is applied to movable property at first, and then to immovable property later. Because different choices of the mode of change in real rights, the suitable object of bona fide possession in modern various countries is divided into two modes： only being applied to movable property and applied to movable property and immovable property, both of which are reasonable. As a regulation of innocent purchase of immovable property in our country, ＂Reality of laws＂ is a correct choice.
