摘要
人类社会的利益结构具有层次性和复杂性。在政治文明框架下,政府应力求公民权利和公共利益的平衡。在当前的城市房屋强制拆迁领域,要做到公民权利和公共利益的平衡,必须使公共利益的认定法定化,拆迁过程遵照合理的程序,切实保障居者有其屋,实现拆迁公正,彰显政治文明。
Human society＇s benefit structure is hierarchical and complex, government should make effort to seek balace between citizen right and public interest under the frame of political civilization. In the domain of house compulsory relocating, in order to achieve balance between citizen right and public interest, we must make public interest legalized, obey reasonable procedure, safeguard the tenant to have its room, realize relocation to be fair, showing politics civilization.
