摘要
在市场经济条件下的集体协商劳动关系中,工会应当证明自己确实可以代表员工的利益和愿望,并且其法律主体地位应该具有实然法意义上的严格界定——这不仅是法律意义上的要求,更是实践意义上的需求。因此需要我们对集体协商劳动关系中工会组织的法律地位有一个正确和适当的认识:在最大限度维护劳动者利益的同时,确立工会正当的法律地位和充分的独立自治权,以保证集体协商机制能兼顾公正和效率,得以不断地发展和完善。
Under the market economy, it should be testified that Trade union is the representative of laborers' fights in collective negotiation and interests, and its legal status should be defined with the substantive law. Not only on the principle of law but on operation of law, we must have an proper consideration of the legal status of trade union in the collective negotiations and labor relations: When it safeguard laborers' rights and interests, trade union must establish its proper legal status and right to improve the fairness and efficiency in the system of collective negotiations, and to develop it constantly.
