摘要
说服是法律语篇的基本功能。说服分为显性说服和隐性说服,隐性说服不易被识别或反驳,因此所产生的作用更强。本文借助相关的理论和方法,集中研究司法语篇中隐性说服的特点和表现,对认知反应模式进行了改进,强调了说服过程的互动性。首先界定法律语篇中的隐性说服,对隐性说服进行分类;然后分析隐性说服过程中的语言使用和信息利用,揭示隐性说服的一系列表现形式;最后分析和解释说服者和被说服者对隐性说服的反应以及隐性说服的效果。研究结果说明,司法语篇中存在大量隐性说服,可以从评价、模糊语、预设等角度进行分析,互动认知模式则可以有效处理隐性说服过程。
One of the prime aims of legal discourse is persuasion,which can be either explicit or implicit.Implicit persuasion is usually more powerful since it may evade immediate recognition or rebuttal.This paper studies the features of implicit persuasion in legal discourse by drawing on relevant theories and methods within the framework of an interactive cognitive model.Implicit persuasion,which is operationalized as the elements that do not appear as the information focus of a sentence,is first classified,then analyzed in terms of its linguistic representation and expression with examples drawn from a corpus of legal language.The analysis shows that implicit persuasion finds expression in such discourse features as evaluation,hedging,presupposition,intertextuality and conversational implicature,which are capable of bringing out the effect of implicit persuasion.Although it usually influences those who are persuaded,persuasion can also have an effect on the persuader due to interaction,lending support to the validity of the interactive cognitive model in its application to the analysis of implicit persuasion.
