国有企业纳入WTO《政府采购协定》问题研究

An Approach to the Admittance of the State-Owned Enterprise into the GPA of WTO

2007年末中国已向WTO秘书处提交附录1初步出价清单,启动加入WTO《政府采购协定》(GPA)谈判。中国提交的附录1初步出价清单中并没有包括国有企业,这与欧盟等GPA成员的期望相违背。国有企业是否纳入GPA管辖,这是我国加入GPA谈判可能遇到的最棘手的问题之一。GPA文本没有对应纳入管辖的政府采购实体进行明确界定,但是相关条款体现的"政府的控制或影响"标准以及实践发展中所形成的"受约束实体的控制"原则,有助于为我国在国有企业是否纳入GPA管辖等问题上的出价和谈判提供指导。

By 2007, China has submitted Appendix 1 as a preliminary bid list to initiate negotiations for the membership in the GPA of WTO. But, out Of the expectation of the European Union and other GPA members, this list does not include China＇s state-owned enterprises. Whether China＇s state-owned enterprises should be governed by GPA or not may be one of the great problems to deal with during the negotiations of China＇s access to GPA. Although the GPA text does not give a clear definition to the government procuring entity, the related provisions as well as some doctrines of the ＂control of an entity governed by GPA＂ developed in GATT or WTO cases, prescribe the standard of the ＂governmental control or influence＂, which will be useful to guide the offer and bargain with the admittance of China＇s state-owned enterprises into the jurisdiction of GPA.
