划拨土地使用权市场化的制度经济分析

Transfer of Land Use Right from an Institutional Economics Perspective

针对我国市场经济体制确立后划拨土地使用权制度本身暴露的缺陷问题,试图从产权、制度变迁的角度讨论划拨土地使用权市场化的问题,对其产生的原因、市场化过程中各行为主体的目标、动机及主体的博弈行为进行分析。研究发现:应从土地产权的明晰界定、产权流转、收益权的实现以及土地资产的税租费改革和土地市场法规制度的健全等几个方面来完善和规范划拨土地使用权市场化。

Deficiencies in transferred land use fight have gradually emerged after the establishment of market economy system. This paper intends to discuss the marketability of the transferred land use fight from the perspectives of property right and institutional change by analyzing the reasons and the objective and motivation of different behavior subjects. The result shows that efforts should be made to consummate and standardize the marketability of the transferred land use fight in terms of the land property definition, allowance of land use right transferring, tax-rent-charge reform of land assets and consummation of land law and regulation systems.
