摘要
我国城市房屋拆迁补偿制度存在着许多缺陷,其中以忽略土地使用权补偿最为明显,《城市房屋拆迁管理条例》作为房屋拆迁的法律依据更是对土地使用权只字未提,这不得不说是立法的一大憾事。城市房屋拆迁从性质上看是行政征收的一种,其补偿应当与损失相称,至少不能少于损失,否则就会导致拆迁纠纷的出现。因此,在城市房屋拆迁补偿中,必须包含土地使用权之补偿。
There are many flaws in the present urban housing removal compensation system. The most obvious one is the neglection of land use right compensation .It has never been mentioned in the 《Administrative statutes on urban house removal》 . Urban house removal is a kind of administrative collection. The compensation should be in term with the loss. Otherwise, it will lead to relocation conflict. As a result, some kind of compensation standard must be legalised.
