从价值权衡的角度谈我国刑事再审理由

On Reasons for China's Criminal Retrial from the Perspective of Value Balance

再审,作为一项人为制度,难以摆脱人类的局限性,然而,这种局限性可以经过人为设计达到不利益最小化的结果,这需要我们对价值进行判断与权衡,使其在相容相辅的过程中达到更高层次上的统一。由于我国再审理由的设计缺乏正确理念的指导,致使在实践操作上出现不少问题。因此,有必要对我国再审理由进行探讨,并予以重新设计,使之成为刑事诉讼法修改的一个亮点。

The retrial, as a man--made system, is difficult to shake off the limitations of human beings. However, such limitations, after human special design, may not minimize the interests of the results, which require us to iudge and balance the value to make them reach a higher level of unity and be compatible with and complementary to each other. Since the reasons design of China＇s retrial lack of proper guidance of correct concept, some problems are caused in practice. Therefore, it is necessary for China to explore reasons for retrial and redesign so that it will become one of the highlight of the amendment of Criminal Procedure Law.
