摘要
承租人优先购买权纠纷的解决必须立足于我国现实国情,充分考虑民众正义理念,在法律规范不明的情形下,坚持诚实信用原则,维护交易习惯,有效平衡承租人、出租人和第三人的利益,实现法律理性与传统裁判思维的良好结合。同时,在立法上也必须从多方面完善承租人优先购买权制度,以减少社会现实冲突及裁判中的法律适用冲突。
The dispute's solution of lessee's right of preemption must base on our country's realistic national condition, fully consider populace's just idea, in the case of uncleared standard, insisting honest and the credit principle, maintaining the transaction custom, balancing the benefit between the lessee and the lessor and the third person effectively, realizing the good combination between the legal rationality and the traditional judgment's thought. At the same time, it must perfect the system of the lessee's right of premption from legislation, reducing society's conflict, and the conflict of applying law in judgment.
