董事竞业禁止义务刑法调控机制的立法完善

On Legislative Perfection of Criminal Regulating Mechanisms to Director's Obligation of Prohibiting Improper Competition

我国刑法第165条初步构建了董事竞业禁止义务的刑法调控机制,而这一机制存在法网疏漏、规则模糊、缺乏操作、有违平等诸缺陷,因此应当完善立法,建立明确的、完备的、平等的、可操作的刑法调控机制。

Section165 of Criminal Law of the PRC, has established the basic mechanism that regulates the directorg obligation of prohibiting improper competi- tion. However, there are such legislative defects as omissions, illegibilities, violation of the principle of equality, and loss of operation. So we should improve the legislation and establish a clear, comprehensive, equitable and practical controlling mechanism.
