论电力行业垄断行为的法律规制

The Legal Rules and Regulations for Power Industry's Monopoly Behavior

随着《反垄断法》的通过,学界更加关注电力行业这一特殊领域。电力行业在我国是传统的自然垄断行业,在电力市场化改革的今天,需要结合《反垄断法》,对电力行业进行合理的法律规制。在介绍电力行业的基本理论基础上,分析了其垄断行为的表现形态特征,并对比了国外电力改革的经验,提出了"有效竞争"的观点。

With the adopting of ＂antimonopoly law＂, the educational circles pay close attention to this special field of power industry. The power industry is a traditional natural monopoly industry in China. With the marketing-reform of electricity, the power industry needs to carry on the rational legal structure combine with the ＂antimonopoly law＂. On the basis of basic theories of the power industry, this article analyzes the characteristic of this proposes the view of ＂effective competition＂. field, compares with the experience of the foreign electric reform, and proposes the view of ＂effective competition＂.
