论中国刑法现代化视野下的犯罪概念

On the Concept of Crime in the Context of the Modernization of Chinese Criminal Law

犯罪概念是刑事法学的基本范畴之一,不同的语境会得出不同的犯罪概念,而不同的犯罪定义则反映了不同的犯罪观念。贯穿中国刑法现代化的思想主线是形式合理性与实质合理性的融合、社会保护与人权保障的统一,因此,刑法现代化视野下的犯罪概念也应体现这一价值取向。中国现行刑法规定的犯罪定义在总体上契合刑法现代化的要求,但在具体说法上应修改为:符合刑法规定的、侵害法益且应当承担刑事责任的行为。

The concept of crime is one of the basic content of criminal law,and different crime concept depends on different context and concept.The mixture of form rationality and substantial rationality and the unity of social protection and guarantee of human right are the concept of modernization of Chinese criminal law.Hence,the concept must be embodied in the concept of crime in the context of the modernization of Chinese criminal law.In general,though the concept of crime in the current Criminal Law fits in for modernization of criminal law,it should be modified as the act conforming to criminal law,infringing on legal benefit and assuming criminal responsibility.
