证明责任视野中的犯罪构成研究

Study on Constitution of Crime in the View of Burden of Proof

两大法系的犯罪构成体系都具有推定机能。而我国犯罪构成体系的推定机能丧失,由此造成证明责任分配的混乱。为发挥犯罪构成对证明责任分配的指导功能,我们应在借鉴国外经验的基础上完善我国的犯罪构成体系,以实现其推定机能。

The systems of constitution of crime in two legal systems have presumption functions. But the system of constitution of crime in China is lack of the presumption function, and this has also caused confusion in the distribution of the burden of proof. In order to achieve its guidance function to distribution of the burden of proof, we need improve the system of constitution of crime in China and implement its presumption function on the basis of referring to foreign systems.
