略论石油贸易与WTO体制

Oil Trade & WTO Regime

鉴于石油问题多边化的敏感性,国际社会迄今未能建立起从总体上协调石油贸易的适当的制度框架。WTO/GATT多边贸易体制从未明确将石油排除在适用范围之外,并曾受理过石油贸易争端,但历史原因及规则缺陷使得其对于石油贸易措施的规制乏善可陈。随着"能源安全"、"气候变暖"举世瞩目,在WTO框架下展开能源谈判的动力日益充足,WTO应在国际石油贸易领域扮演一个更为积极与重要的角色,将石油贸易纳入有效规制,引导其健康有序地发展。
