摘要
我国《教师法》自1994年1月1日起实施以来,对于保护教师的合法权益与促进教师队伍建设起到了积极的作用。随着教育改革与发展,《教师法》存在的不完善之处也越来越显现出来,亟需要进行修订。本文通过将我国《教师法》与台湾地区《教师法》从法律体例结构、立法宗旨及教师地位、教师的权利与义务、对教师队伍的管理制度、教师的待遇、教师的培养与培训等方面进行比较,说明两法之间的相同点及区别。借鉴台湾地区《教师法》对我国《教师法》的修订工作有一些有意义的启示,本文在分析基础上提出十条具体的修改建议。
Since the implementation of Teacher Law in China's Mainland on January 1, 1994, it has played an active role in protecting teachers' legal rights and interests and promoting the construction of teacher team. However, with the reform and development of education, more and more deficiencies have been detected in the Teacher Law which needs early revision. This study demonstrates the similar points and differences between mainland's Teacher Law and Taiwan's Teacher Law by comparing them from aspects of legal system structure, legislative purpose and teacher's status, teacher's rights and obligations, management system of teacher team, teacher's salary, the cultivation and training of teachers and so on. Furthermore, enlightened by Taiwan's Teacher Law in the process of revising mainland's Teacher Law, ten specific revising suggestions are presented in this paper.
