公权力的异化及其控制

The Alienation of Public Power and Its Control

公权力是国家的主要象征,也是国家一切职能活动的根本前提。如果公权力偏离公共利益这个目标,就是权力异化。构建社会主义和谐社会,必须有效防止和控制公权力的异化,使公权力与私权利保持有机的和谐。防止和控制权力异化要做到:理念上自觉厘清公权力的行使边界;对权力实行合理的分工和制衡;完善监督的网络体系建设;对权力的合法性和运行程序进行事前控制;培育市民社会,以权利制约权力;加强阳光政府建设,提高公权力运作的透明度;发展与重视"第三部门"的作用,柔化行政权力;加强责任制度建设,以责任制约权力。

Public power is the main symbol of a country, and the fundamental premise of a countrie＇s all functional activities as well. When public authority falls away from the objective of public interest, alienation of power is appeared. Effective prevention and control of the alienation of public power is necessary in building a socialist harmonious society. In order to prevent and control the public power alienation, public power and private right should be clearly divined; reasonable division of powers and balanced control should be implemented; supervision and monitoring system should be improved ; legitimacy of power and control procedures should be set prior; civil society should be nurtured, power should be controlled by rights; government should be more transparent; the role of the＂ third sector＂ should be developed and emphasized;the responsibility system should be enhanced and the power should be bound with the responsibility.
