土地承包经营权制度评析

The Analysis on the System of Land Leasing Right

"土地承包经营权"诞生于20世纪70年代末实行的家庭联产承包责任制。土地承包经营权是中国农民及其他农业生产经营者的重要权利。学界长期对土地承包经营权存在争议,主要是在土地承包经营权的性质、设立方式、流转范围等方面存在分歧。《物权法》第十一章专章对土地承包经营权进行了规定,该规定对学界的争议作出了比较满意的回答。

＂The concept of land leasing right＂ was born in the late 1970s on the basis of the household contract responsibility system. It＇s Chinese farmers＇ and other agricultural production operators＇s important right. There is fierce dispute in Academia, mainly in term the nature of the right to operate and the way of circulation of land. Chapter 11 of ＂Property Law＂ provides for the right to operate and the provision settled the dispute.
