摘要
阐述了我国事业单位人事争议司法实践的立法进展,分析了人事争议司法实践在事业单位工作人员的范围、案件受理、聘用合同与聘任合同的关系、举证责任分配等司法实践中存在的问题及其完善适用对策。
This paper expounds the legislative development of the judicial disposal system about personnel disputes in the institutions in China, and analyzes the problems and the perfection about the judicial disposal system about personnel disputes in the institutions about the staff, the case acceptance, the relations between the employment contracts and appointment contracts as well as the onus of proof.
