科学发展观是坚持以人为本,全面、协调、可持续的发展观,建设生态文明已成为落实科学发展观、构建和谐社会、实现经济社会环境协调发展的迫切任务。生态环境意识、环境法律政策、环境行政执法和司法等诸多因素,制约了生态文明建设的进程,公众参与、生态补偿、环境责任及纠纷解决问题是生态文明建设中面临的难题,应通过建立和完善公众参与机制、生态补偿机制、生态安全预警应急机制、ADR争端解决机制等环境法治保障机制予以解决。
