摘要
盎格鲁萨克逊时期,英格兰土地关系状况使得当时还不具备产生统一的土地法的基本条件。诺曼征服以后,英格兰所有的土地关系都被纳入到统一的土地保有制之中,在历史的发展进程中,土地保有制不断发生变化,但这丝毫没有改变其在英国土地关系中的基础性地位,时至今日,它依然是英国土地法律关系的基本模式。英国土地保有制的特殊性,为土地法产生和发展奠定了基础,不仅排除了在土地法上产生土地所有权的可能性,也注定了英国走上一条与欧洲大陆各国不同的土地法建构道路。
Feudalism may fred its origin in Anglo- Saxon England, however, there was no uniform model of land legal relationship in England then. Ever since the Norman Conquest in the 11 th century, the dependent tenure system had been laid down as the fundamental legal framework to all land relations in England. With the development of society, the tenure system evolved accordingly, but it still remained as the fundamental legal framework of English land law, every acre of land in England are still been held to the Queen today. The formation and structural peculiarity of English land tenure system lay the basis to English land law, which is the key to the understanding of Anglo- American real property law.
