论后现代主义对法律主体的解构和建构——以过程哲学为视角

On Postmodern Deconstruction and Construction of Legal Subject——From the Perspective of Process Philosophy

过程哲学以其自身独特的视角对现代的二元对立、理性至上、机械论和形而上学等观念进行了批判,从这一点上看,过程哲学是后现代主义的重要组成部分。然而,同那些一味地破坏和全盘否定的解构的后现代主义不同,过程哲学的起点在于对现代性的批判,但却着眼于建构。过程哲学的这种建构主义同样体现在其对现代法律主体的重建上。

Process philosophy, from its unique perspective, criticizes modern dualism, supremacy of reason, mechanism and metaphysics, and can be regarded as an important part of postmodernism. However, different from the deconstructive postmodernism which aims at total deconstruction and negation, process philosophy starts from criticism of modernity and focuses on construction. Therefore, it is constructive postmodernism. This article, guided by the postmodern ideas revealed in process philosophy, and focusing on the transformation of legal subject, expounds the course of establishment, deconstruction and construction of legal sub- ject influenced by postmodernism embodied in process philosophy. The purpose is to deepen the understanding of practical value and provide modern legality with theoretical foundation.
