高校学生管理中的“非法治化”现象及对策思考

"Unconstitutional" Phenomena in College Student Administration and Countermeasures

高校学生管理过程中,存在着侵犯学生受教育权、侵犯学生人格权、侵犯学生财产权等"非法治化"现象,这在一定程度上影响了高校依法治校、依法管理的实施。要实现高校学生管理工作的法治化,首先应该更新理念,构建尊重学生权益的学校制度,同时应做到注重落实,实现程序正义和疏通权利主张渠道,保障学生合法权益,从而促使高校管理者转变观念,增强法治意识,并依法建章,真正把高校学生管理工作纳入法治化轨道。

There generally exist unconstitutional phenomena in higher learning institution student administration of encroachments on students＇ right of education, right of personality and right of property, which affect the institutions＇ effort to implement rule of law and administration of law. To realize constitutional student administration, we must first renew ideas and establish a system that pays respect to students＇ rights and benefits, and at the same time lay stress on implementation, realize procedure jus- tice, make right-claim channel accessible and guarantee students＇ legal rights and benefits, and in this way to cause the administrators to change their ideas, enhance consciousness of rule of law and regulation-establishment of law, and lead the student administration to a constitutional way.
