摘要
本文从表见代理制度的历史渊源开始分析,认为适合现状的表见代理制度构成要件应该分情况采用"单一要件说"和"双重要件说",同时,着力分析表见代理制度的表现形式和法律效力,并在此基础上提出今后的立法完善方向。
Beginning with the analysis on the historical source of apprent agent, the article regards the suitable component condition should adopt single condition theory and double condition theory based on different situation, analyse the expressive mode and law force of apprent agent, and then puts forward the improving trend of legislation.
