我国实施宽严相济的刑事政策,在死刑方面采取保留死刑,但严格限制死刑的态度。限制死刑的措施之一就是通过情节来限定,文中从应然与实然两个方面分析了中国今天的死刑除刑情节,并在此基础上进行分类整合,并根据当前死刑除刑情节的适用无统一标准的问题,总结出死刑除刑情节在量刑体系中的逻辑位置,构思了四分法的情节适用结构。

China enforces the leniency--severity criminal policy, and adopts an attitude of retention but restriction on the death penalty. One of the measures of restriction on the death penalty is through the circumstances. The article, from the ought--to--be and practical aspects, analyzes the excluded circumstances of death penalty in China nowadays, tries to classify and integrate them. Because in China nowadays there are no consistent standards in the application of excluded circumstances of death penalty, therefore the article concludes the logical location of excluded circumstances of death penalty in the measurement of punishment system, and finally constructs the four--kind application structure of circumstances.
