摘要
在网上银行交易环境下,消费者客户的合法权益更容易遭到忽视和损害,为此,需要通过法律手段对其给予各种特别保护。这包括借助立法或行业自律机制对极易受到侵害的消费者个人数据与隐私权提供积极保护,通过进一步明确相关法律规则对消费者的知情权、选择权和公平交易权等提供具体保护,以及对格式合同中不合理地增加客户一方负担或损害客户一方利益的各项条款通过强制性法律规范予以矫正。
Under the circumstances of In the internet banking transaction, the rights of customers are much more easily ignored or injuced, so it is necessary to provide them with special protection in the field of law. It includes that the individual data and privacy rights of consumers should be protected actively by legislation or self--regulation, that the rights to know, to choose, and to a fair deal should be protected by concrete legal measures, and that the clauses stated in the standard contracts, which unfairly add more liabilities to or unreasonably injure the benefits of the customer, should be corrected by enforceable statutory rules.
