关于《中华人民共和国劳动合同法》的几个问题

摘要 《劳动合同法》于2008年1月1日正式生效,伴随着它的实施,出现了一系列问题,许多用人单位和劳动者产生众多的困惑,甚至有人认为:《劳动合同法》是对《劳动法》的修改。许多用人单位认为:该法过多地保护了劳动者的权益。也有个别的用人单位全然不把《劳动合同法》的规定当回事,现实中,违法用工的情况时有发生,为此,本文对《劳动合同法》做了几点说明。 Labor and Contract Law of the People' s Republic of China became effective officially in January 1, 2008. Its implementation resulted in a series of problems and many employers and employees felt confused about the rugulations of the new law. Some of them even thought the new law was the revision of the old Labor Law. Many employers believe that the new law exeessively protects employees' rights and interests and some employers neglect the stipulation of the new law completely. In reality, illegal employment occurred now and then. For the above reasons, this thesis aims to make some explanations about the law.
